Judge Cabral appeals ruling against Cassation return

Judge Luis María Cabral has appealed the ruling which dismissed his plea to be reinstated to the Federal Cassation court, as the march called for tomorrow in support of the magistrate appears to lose momentum.

Cabral’s lawyers presented the appeal today to judge Esteban Furnari, who had dismissed the injunction to return to Cassation as a substitute member last Friday. Tomorrow Cabral will appear before the Federal Administrative Court to make his case for a return to the panel of judges.

Tomorrow was also the day signalled by leading opposition politicians and legal figures for a march in favour of the judge’s return, a movement that has lost impetus with the rulings against him. While the opposition spoke publicly in favour of mobilisation when Cabral was removed from the court, now leading figures prefer to keep silent about the planned protest at 6pm in Tribunales.

Last week Cabral called the law which governs substitutes in the Judiciary «inconstitutional», given that «it allows for the substitution and replacement of judges according to the tastes of a circumstantial majority on the Magistrates’ Council».
