AFIP tax agency informed it appealed a ruling by Mar del Plata Federal Judge Alfredo López, who ordered the entity to immediately grant a couple authorization to purchase US$16,000 to buy a home.
The Ricardo Etchegaray-led tax agency based its decision on the fact that “ it is illegal to buy foreign currency for the purchases of homes, as expressly forbidden by communiqués A number 5318 and 5330 of the Central Bank. Under the argument of purchasing dollars to buy a home, we could verify in the respective documents that the couple failed to include the proof of purchase or deed,” AFIP informed.
“This could lead to fake situation to use the appeal for legal protection as a way to save dollars in an undercover manner, which is expressly forbidden by the current regulations as well.”
The tax agency also reported that an inconsistency was found in the couple’s fiscal situation which makes it impossible for them to buy foreign currency.
The legal order «is impossible to comply with because AFIP lacks the authority to allow the purchase of dollars to buy homes and as a matter of fact cannot allow it because the buyer needs permission of the Central Bank.»
