Federal judge María Servini de Cubría has ruled out ending January’s court recess in order to hear the accusations filed by prosecutor Alberto Nisman, in which the AMIA investigator alleges President Cristina Fernández de Kirchner and other government figures of covering up part of the 1994 bombing attack.
The magistrate ruled in the place of judge Ariel Lijo, under whose jurisdiction the case falls and who is currently on holiday due to the judicial recess, according to court sources.
Servini considered that the accusation «does not fit into any of the possible areas» which would allow for the recess to be lifted, and that Nisman’s presentation lacked «elements of proof» to back up his request for the courts to be brought back in session, for example in order to impose bans on overseas travel on those accused and other measures.
The judge also ruled that it is Lijo, as the magistrate in charge of federal court 4, who must decide if it is correct to link Nisman’s accusations with previous charges overseen by him over irregularities in the AMIA investigation process. For Servini, some of the allegations made public yesterday by Nisman are new, and must be treated as such by court procedure.
Ámbito.com heard from a government source that the Fernández de Kirchner administration feels vindicated by the decision, asserting that «part of Comodoro Py does not back this madness.»
