The San Martín Federal Chamber has confirmed that train driver Daniel Alberto López will face criminal charges for the crash which occurred in Castelar on June 13 2013, when two formations collided leaving three dead and more than 60 injured.
Judicial sources today revealed the court’s decision to charge the operator of «aggravated criminal negligence».
In the same resolution, the Chamber lawyer Valeria Cobacho’s request to drop the investigation, due to the fact that the video which shows that the driver did not stop the train and did not suffer any harmful incident beforehand had been damaged.
«At the very first instance, it could be seen that during the journey from Morón to the point of impact [the brakes] were working. However, they were not activated by driver Daniel Alberto López, in a clear transgression of diligent operating procedure implicit in his role as driver,» the judges explained in the resolution.
The magistrates also found that López «passed with great speed signals that were yellow (caution), turned off and red (stop)».
Federal prosecutor Sebastián Basso or one of the sitting judges can now start the procedure in order to bring López to trial as the only person charged in the case, while the defence will be able to appeal the decision.
