Bossio questions ruling against ANSeS

State social security agency ANSeS head Diego Bossio came on stage after yesterday the Supreme Court warned the national government over challenging “without cause” a judge handling social security cases; “We have never stopped paying pensioners”, the official said.

The SC’s rulling also indicated that the “massive use” of this practice is “a procedure abuse that judges should not tolerate,” because it ends in an “institutional problem” and “damages” those pensioners taking their case to court to improve their situation.

Defending ANSeS policies, Bossio told reporters “We are paying and obeying all court rulings. More over, this month we are going to pay a record-high of 4,200 law suits conducted by pensioners.”

The Supreme Court upheld a ruling by a federal court that had rejected the challenge filed by the state social security agency ANSeS against Judge Luis René Herrero.

“The ruling questions our pension policy, while we believe that we have the right policy thanks ton which Argentina has 2.5 million new pensioners. Our idea is to keep working on the same path”, the official said.

The Supreme Court said that tabling challenges en masse against judges warps the nature of the procedure and harms legal cases. “Allowing for procedure abuse is something that judges should not tolerate,” said the Court.

Herrero was challenged in a case filed before a federal court in Salta province concerning a pension claim filed by retiree Emilio Aguilera Grueso. That ruling was appealed and was handled by an appeals court headed by Herrero.

ANSeS’ challenge halted for nearly a year and a half all those cases that reached Herrero’s court.
