On May 20 1998, the ruling administration of Carlos Menem granted a life annuity benefit to Supreme Court Justice Carlos Fayt in a move to negotiate the magistrate’s resignation to Argentina’s highest tribunal.
According to the 179 resolution that was signed by then social development minister Santiago de Estrada, Fayt had to leave his seat in the Court in order to start collecting the monthly benefit.
However, the judge changed his mind, deciding to continue in the Supreme Court as soon as the annuity was authorized with versions indicating that members of the then Alianza political coalition convinced Fayt to remain in his position, alluding Menem’s government was seeking to use him to get “automatic majority” in the tribunal.
