Justice Carlos Fayt, the oldest Justice, said that the Supreme Court should “remain with five members” after Justice Raúl Zaffaroni’s resignation becomes effective on December 31, leaving the Court with only four members.
“We have not met to discuss whether we need a new (member),” he said in an interview with Del Plata radio. “We will wait and see what the government does. It would be desirable to remain with five members.”
Fayt remarks are in tune with those of his colleague Deputy Chief Justice Elena Highton de Nolasco who has said that “ideally” the government should name a replacement for Zaffaroni, who decided to leave mainly to the acceptance of the article 99 of the national Constitution, which stablishes judges’ retirement at the age of 75.
Opposition lawmakers have repeatedly expressed their refusal to give consensus for the Executive to name a new justice, an appointment that needs the approval of two thirds of the Senate to become effective.
Fayt also ratified his decision to continue as justice, despite him being 96 years old.
